Here is some basic information about the processing of your personal data, as well as about your rights associated with the processing of your personal data.

 

Definition of terms:

 

Recipient – A personal data recipient is any entity to which our company gives your personal data,

 i.e. essentially any person who has access to your personal data through our company.

 

Data protection officer – A data protection officer is a person who supervises the protection of personal data of individual data subjects (i.e. also your personal data) in the company that processes your personal data. As a data subject, you can contact the data protection officer with any questions related to the processing of your personal data and the exercise of your rights arising from the General Data Protection Regulation. Your rights under the General Data Protection Regulation are described below.

 

Data profiling – Data profiling is any form of automated personal data processing that consists of the use of such personal data to evaluate certain personal aspects concerning a natural person. Profiling provides an analysis or prediction of aspects of the concerned natural person related to performance at work, financial circumstances, health, personal preferences, interests, reliability, behaviour, location or movement.

 

It is basically a way of processing personal data, based on which the processed personal data is used to create a profile of the data subject; this profile helps predict the behaviour or personal preferences of the data subject.

 

Automated individual decision-making – Automated individual decision-making is a way in which the rights and obligations of data subjects are decided by a computer programme; it is basically a way to make decisions without the human factor, or the human factor only sets the rules on the basis of which the computer programme executes the decision.

 

Legal basis – The legal basis of data processing is the legal reason on the basis of which our company as the controller is authorised to process your personal data.

Your rights as a data subject related to the protection of personal data:

The right of access to personal data:

As the data subject, you have the right to obtain confirmation from the controller (i.e. our company) about how we process your personal data.

If we process your personal data, you have the right to gain access to the personal data we process, and you also have the right to receive the following information regarding the processing of your personal data by our company:

the purpose for which we process your personal data

the categories of your personal data we process

information about recipients, or at least categories of recipients, to whom your personal data has been or will be transferred, particularly recipients from third countries, or recipients who are international organizations

if possible, information about the expected retention period of your personal data or, if this is not possible, information about criteria for determining the retention period

information that you have the right to request that the controller (i.e. our company) rectify your personal data, to request their erasure or restrict their processing, or that you have the right to object to such processing

information that you have the right to file a complaint with the supervisory authority

information that if we haven't received your personal data directly from you, you have the right to obtain all available information concerning their source

information on whether we use automated decision-making, including profiling, and if we use an automated decision-making method, you have the right to receive information about the procedure used, as well as the meaning and anticipated consequences of such processing

If we transfer your personal data to a third country or an international organization, you have the right to be informed about reasonable safeguards regarding the transfer (i.e. how the protection of your personal data is ensured in third countries).

As the controller, our company is obliged to give you a copy of your personal data that we process. For any additional copies that you, as the data subject, request, our company is entitled to charge a reasonable fee corresponding to administrative costs. If you, as the data subject, send a request electronically, we will send you the information in an email (to the email address provided in your request), unless you, as the data subject, request another method.

The right to rectify personal data:

As the data subject, you have the right to have our company, as the controller, rectify incorrect personal data without undue delay. With regard to the purposes of processing, you, as the data subject, have the right to add data to your incomplete personal data, including a supplementary declaration.

As the controller, our company has an obligation to notify each recipient of this personal data of any changes to the personal data, unless this proves impossible or requires unreasonable effort. If you, as the data subject, request this, our company, as the controller, will provide all information about the recipients that our company is obliged to inform.

The right to erasure of personal data ('the right to be forgotten'):

As the data subject, you have the right to have your data erased without undue delay by our company as the controller. Our company, as the controller, is obliged to erase your personal data without undue delay if any of the following reasons are met:

if your personal data are no longer needed for the purposes for which we obtained it or otherwise processed it

if your personal data are processed on the legal basis of your consent and you, as the data subject, withdraw the consent on the basis of which the data is processed, and there is no longer any other legal basis for the processing of your personal data

if you, as the data subject, exercise your right to object to the processing of your personal data referred to in point 5

if your personal data are processed unlawfully

if your personal data must be erased in order to comply with a legal obligation arising from EU or Czech legislation

if the personal data was obtained in connection with the offer of information society services and a child's personal data is being processed

If our company, as the controller, publishes your personal data and we are obliged to erase your personal data, we inform the controller who processes your personal data that you, as a data subject, request the erasure of all references to this personal data, their copies and replicas. We will take these steps with regard to the available technology and costs, in the form of appropriate measures, including technical measures.

As the controller, our company has an obligation to notify each recipient of this personal data of the erasure of the personal data, unless this proves impossible or requires unreasonable effort. If you, as the data subject, request this, our company, as the controller, will provide all information about the recipients that our company is obliged to inform.

The right to restrict processing of personal data:

As the data subject, you have the right to have our company, as the controller, restrict the processing of your personal data in one of the following cases:

if you, as the data subject, challenge the correctness of your personal data, you have the right to have the processing of your personal data restricted for a period that allows our company, as the controller, to verify the correctness of your personal data

if the processing of your personal data is unlawful and you, as the data subject, object to the erasure of your personal data and instead request the restriction of their use

if our company, as the controller, no longer needs your personal data for processing purposes, but you as the data subject need them to prove, exercise or defend your legal claims

if you, as the data subject, object to automated decision-making, including profiling, that our company, as the controller, may use in the processing of your personal data, you have the right to have the processing of your personal data restricted for a period that allows our company to verify whether the legitimate reasons of our company, as the controller, are sufficient for this method of personal data processing

During the period in which our company, as the controller, restricts the processing of your personal data, our company is only authorised to retain your personal data. Our company, as the controller, is only authorised to perform other processing operations:

if you grant your consent

if it is necessary to prove, exercise or defend legal claims

if it is necessary to protect the rights of another natural or legal person

if it is necessary for the purpose of the important public interest of the European Union or the Czech Republic

Before the restriction of processing is lifted, our company, as the controller, is obliged to inform you of this fact.

As the controller, our company has an obligation to notify each recipient of this personal data of the restriction of processing, unless this proves impossible or requires unreasonable effort. If you, as the data subject, request this, our company, as the controller, will provide all information about the recipients that our company is obliged to inform.

The right to object to personal data processing:

As the data subject, you have the right to object to the processing of your personal data at any time for reasons related to your specific situation, concerning data processed on following legal basis:

if the processing of your personal data is unavoidable for the fulfilment of a task in the public interest or in the exercise of public authority entrusted to the controller

if the processing of your personal data is necessary for the legitimate interests of the controller or a third party

As the data subject, you have the right to object to profiling performed under the legal bases mentioned in the previous sentence. After exercising your right to object in accordance with this point, our company, as the controller, may not process your personal data further, unless our company proves necessary legitimate reasons for processing your personal data that outweigh your interests, rights and freedoms, or if our company proves that the reason for the processing is to prove, exercise or defend legal claims.

 

As the data subject, you also have the right to object to the processing of your personal data if your personal data is processed for the purposes of direct marketing, as well as the right to object to profiling to the extent that it is related to direct marketing. After exercising your right to object under this point, our company, as the controller, may not process your personal data further for direct marketing purposes.

As the data subject, you have the right to exercise your right to object by automated means using technical specifications.

The right to data portability:

As the data subject, you have the right to obtain personal data concerning you that you have given to our company, as the controller. Our company, as the controller, is obliged to give you this data in a structured, commonly used and machine-readable format.

As the data subject, you also have the right to request that our company transfer your personal data to another controller.

Our company is obliged to transfer your personal data on the condition that your personal data is processed by our company by automated means (i.e. that we have your data in our internal computer database), and that your personal data is processed by our company on one of the following legal bases:

on the basis of your consent

if our company processes your personal data on the basis of a contract concluded between you as the data subject and our company, in the performance of which it is necessary for us to process your personal data (e.g. employment mediation contract, where we have to process some of your personal data in order to search for a suitable job for you)

When exercising your right to the portability of your personal data, you have the right to have your personal data transferred directly from our company to another controller, provided that this is technically possible.

The right to revoke your consent at any time without affecting the lawfulness of processing performed prior to the revocation:

if our company processes your personal data on the legal basis of your consent

if you have given our company a statement that you agree to the processing of your personal data by our company either in writing on paper or electronically (e.g. by filling out a form on the Internet), you have the right to withdraw your consent at any time.

The revocation of your consent shall not affect the legality of the processing of your personal data based on your consent given before its revocation. As the controller, our company is obliged to ensure that revoking your consent to the processing of personal data is at least as simple as providing your consent was.
